In recognition of 2021 National Pro Bono Week, VOLS Unemployed Workers Project and the New York State Bar Association (NYSBA) hosted an Unemployment Insurance Hearings Clinic for individuals in need. Click the video below to access the virtual clinic.
The Issue: NYSBA and VOLS hear from New Yorkers every day asking for help with their unemployment insurance (UI) hearings. Most of these claimants lost their jobs in the wake of the COVID-19 crisis; many of them are now being charged with overpayments. Hearings are currently held by phone before Administrative Law Judges and do not require in-person appearance or travel.
The Work: Pro Bono representation at a UI hearing gives volunteer attorneys an opportunity to prepare a case, engage in client interviewing, conduct a direct examination and possibly a cross examination if the claim is challenged. Representation at a hearing greatly increases the chances for a claimant to prevail in their benefits claim. From start to finish, on average, preparation of a case and representation at a phone hearing usually is about 15 hours.
With unemployment remaining at historic highs, unemployment insurance benefits are a lifeline for an individual or family for whom there is no other source of income.
The Clinic: Via Zoom, the VOLS Unemployed Workers Project will conduct a 1-hour presentation on unemployment insurance law and the hearing process. After the presentation, attorneys will have time to review their client’s file and then will meet with their client in a break-out room. VOLS staff will remain in the main zoom room to answer any questions.
The Agreement: All participants agree to take on one pro bono UI hearing with VOLS’ guidance and mentorship. Most participants will be matched with their client the day of the clinic; others will be matched shortly thereafter. Given the commitment to pro bono work, CLE credits will be free of charge!
